Why I Love my Dollar Tree Contest
THE FOLLOWING CONTEST IS VALID AND ONLY INTENDED FOR LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER. VOID IN AK AND HI AND WHERE PROHIBITED. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING.
The Contest Entry Period begins March 1, 2010 at 12:00:01 am Eastern Time (“ET”) and ends March 21, 2010, at 11:59:59 pm ET (the “Entry Period”).
The Contest Voting Period begins March 23, 2010 at 12:00:01 am Eastern Time (“ET”) and ends April 2, 2010, at 11:59:59 pm ET (the “Voting Period”).
HOW TO ENTER: Visit www.WhyILoveMyDollarTree.com during the Entry Period and follow the on-screen instructions to complete the online entry form with all required information, including your full name, complete home address, telephone number, age and email address. Submit the entry form along with a creative and compelling entry into one of the following categories that explains “Why you Love Dollar Tree”.
The completed entry form and creative materials (audio, video, poem/story, or image) are collectively referred to herein as an “Entry.” Entries must be received by 11:59:59 ET pm on March 21, 2010 to be eligible for the Voting Period. No other method of entry will be accepted or acknowledged. Entries must include all the required information or they will not be eligible.
There is a limit of one entry per person per category. You may enter the Contest under only one name and use only one email address for all of your Entries, and only one of your Entries can be named a Finalist Entry. All eligible Entries (subject to verification) will be posted online at www.WhyILoveMyDollarTree.com (the “Web Site”) during the Voting Period (see below). All Entries submitted will be reviewed before being posted and those deemed to be not in compliance with the entry requirements and restrictions set forth herein, as solely determined by the Sponsor and its agents, will not be posted or eligible for the voting phase of the Contest. Date and time of entry for determination of eligibility and compliance with these Official Rules shall be determined solely by Sponsor’s site/system. In the event of a dispute as to the identity of an entry, such entry will be deemed made by the person named on the entry form.
THE VOTING PERIOD/DETERMINING THE CATEGORY FINALISTS: During the Voting Period the public may visit the Web Site and vote for the best Entry in each category based on creativity and how well the entry captured the Dollar Tree brand. Limit one vote per computer IP address per entry per day. If more than one vote is received from the same IP computer address for the same Entry, all votes from said computer IP address will be void. Sponsor reserves the right to void all votes made through any script, macro, robotic, automatic, mechanical, programmed or similar duplication method. Any attempt by any person to fraudulently circumvent the voting restrictions in order to cast multiple votes for the same entry on any given day will result in disqualification of all such votes received and may result in disqualification of the entrants for whom the improper votes were received if the Sponsor determines that that entrant was involved in any way in the perpetration of such fraud.
At the conclusion of the Voting Period, the entrants who submitted the Entry that received the most votes during the Voting Period in each category will be named the Finalists and will be awarded a Finalist Prize (as described below). In the event of a tie in the voting, the tied Finalist entries will be judged by an independent panel of judges, determined by the Sponsor whose decisions are final and binding on all matters relating to this Contest, based on the following equally weighted (50% each) criteria: (a) creativity, (b) how well the entry captures the Dollar Tree brand. A person can be named a Finalist in only one category.
SELECTION OF THE GRAND PRIZE WINNER: The four Finalists’ Entries will be judged by an independent panel of judges, whose decisions are final and binding on all matters relating to this Contest, based on the following equally weighted (50% each) criteria: (a) creativity, (b) how well the entry captures the Dollar Tree brand to determine one Grand Prize Winner.
ELIGIBILITY: You must be a legal resident of one of the 48 Contiguous United States or D.C., 18 years of age or older to enter this Contest. Employees of Dollar Tree Stores, Inc. (“Sponsor”), BBG, Inc., Alpha Marketing and each of their respective parent companies, affiliates, subsidiaries, divisions, business units, advertising and promotion agencies, Contest judges, (collectively the “Released Parties”) and members of each of their immediate family, defined as spouses, parents, children, siblings and each of their respective spouses (whether such family members are biological, adoptive, step or in-law) and those living in the same household of such employees are not eligible to enter.
DETAILS: Entrants shall not receive any compensation or credit for Sponsor’s use of Entry, other than that disclosed in these rules. Entries become the property of the Sponsor and will not be acknowledged or returned. Entries must include all of the required information as set forth in the on-screen entry instructions and herein or they will not be eligible. Any Entries not in conformance with these Official Rules will be disqualified and not eligible for prizes.
The following requirements apply to each Entry:
BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE AT SPONSOR’S DISCRETION. By submitting an Entry, Entrant agrees that submission is gratuitous and made without restriction, and will not place Sponsor under any obligation that Sponsor is free to disclose or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. Entrant acknowledges that Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. Submission of an Entry grants Released Parties an unlimited, worldwide, perpetual, license and right to publish the Entry in any and all media, without limitation, and without consideration to the entrant. By submitting an Entry you warrant and represent that it: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, and (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Entrants agree to indemnify and hold harmless the Released Parties from any claims to the contrary. By accepting a prize, the winner agrees to irrevocably assign and transfer to Sponsor all of his/her right, title and interest in and to his/her Entry, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have to their Entry. Sponsor reserves the right to alter, change or modify the winning Entry, in its sole discretion. Upon request of Sponsor, winner (or the parent/legal guardian if winner is a minor in their state of residence — AL & NE) shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Entry and of the copyrights transferred and “Moral Rights of Authors” waived under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment.
Released Parties are not responsible for typographical errors or any other errors submitted by the entrant. Entries not complying with all rules are subject to disqualification. No correspondence regarding entries will be entered into with entrants, except as provided herein. Finalists may be required to sign a release to that effect as well as an indemnity holding Sponsor and the Released Parties harmless against any third party claims that may arise out of Sponsor’s use of such Entry. By entering, entrant agrees that he/she has no right to bring (and covenants not to bring) any claim, action, or proceeding of any kind or nature whatsoever against the Released Parties in connection with this Contest. By entering and/or accepting prizes, entrants agree to be bound by the official rules.
PRIZES:
One (1) Grand Prize will be awarded consisting of $1,000 to be awarded in the form of a check.
One (1) Finalist Prize per category will be awarded to the Entrant who receives the highest quantity of votes in their category. The Finalist Prize will consist of a check in the amount of $250.
The prize is non-transferable. Winners are responsible for all applicable federal, state and local income taxes on the total prizes s/he receives. An IRS Form 1099 will be issued to the Grand Prize winner no later than January, 2011. The Grand Prize winner is advised to seek independent counsel regarding the tax implications of prize winnings.
MISCELLANEOUS: The winners will be notified via email on or about 4/9/10 and may be required to sign, have notarized and return an unmodified Affidavit of Eligibility, Publication and Liability Release and a Publicity Release (where permitted by law) within seven (7) days of issuance in order to receive their prize. If notification documents are returned as undeliverable or if the potential winner fails to return required documentation in the time frame specified, the prize will be forfeited and awarded to the entrant who submitted the next highest votes.
By entering this Contest Entrant agrees to release the Sponsor and the Released Parties from any and all liability, loss or damage of any kind incurred with respect to participation in this Contest, the awarding, receipt, possession, and/or use or misuse of any prize. By accepting any prize, the winner also consents to the use of his/her name and/or photo or likeness or biographical information for advertising/publicity purposes in commerce and in any and all media worldwide without limitation or additional compensation, except where prohibited by law.
Entrant further agrees that a) under no circumstances will Entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this Contest, or any prize awarded or use of the Entry, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
INTERNET: The Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Contest or downloading or uploading any materials in this Contest. The Released Parties do not assume any responsibility for any disruption in the Contest, labor strikes, or any other act, circumstance or other unforeseen event outside of the control of the Released Parties.
The Released Parties are not responsible for lost, late, stolen, illegible, incomplete, misdirected, damaged or destroyed entries or for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including, without limitation, the incorrect or inaccurate capture of entry information online. Proof of submission (i.e.: screen shots) is not proof of receipt by Sponsor. Once submitted, Entries become the exclusive property of the Sponsor and will not be returned. Entry material/data that has been tampered with or altered is void. If, for any reason (including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of Sponsor), the administration, security, fairness, integrity, or proper conduct of the Contest is affected or corrupted and cannot be conducted as described in these rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest or to select Winners based on the stated judging criteria from among all valid entries received, up to such time of cancellation, termination or suspension. If such event occurs, Sponsor will post notice on www.WhyILoveMyDollarTree.com.
Sponsor reserves the right at its sole discretion to disqualify any individual (and all of his or her Contest entries) who tampers with the entry process. Automated entries are prohibited, and any use of such automated devices will cause disqualification. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
GOVERNING LAW/JURISDICTION. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF VIRGINIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
